If people have health problems such as diabetes or other health issues caused by their own actions should the employer really have to pay for them to fix it? I
If for example someone got diabetes because they habitually over eat and refuse to exercise should the consequences of their actions be passed on financially to their employer?
I’m not talking about accidents or problems caused in direct relation to work such as lung problems caused by coal mining.
It seems unfair and presumptuous to assume that the company should pay the insurance for someone else’s negligence.
Won’t the increase demand on employers lead to health discrimination (not hiring someone because they are overweight or smoke)?
Is this happening now?

Yeah, I feel you. I have always believed that people should take responsibility for their own health rather than living un-healthy lifestyles and expecting the health care industry to “fix” them.
Unfortunately, in the current environment, employers and insurance companies cannot discriminate against those with self-destructive lifestyles.

Hazardous material endorsement on your license. Depends on your state, but…
The USA Patriot Act changed the requirements for issuance of a new, renewal, or transfer HazMat endorsement on a Commercial Driver License (CDL) document.
All new and renewal HazMat endorsement applicants are required to complete the required Hazardous Materials Endorsement Application and fingerprint collection process through the Transportation Security Administration (TSA) data collection vendor and be approved by TSA prior to issuance of a CDL with a HazMat endorsement. New drivers may be issued a temporary CDL without a HazMat endorsement, pending the background checks.
Drivers renewing or transferring a HazMat endorsement (“H” or “X”) are also required to complete the application and fingerprint collection process at least 30 days prior to their expiration date to initiate the TSA assessment.
Drivers renewing or transferring an “H” or “X” endorsement on or after May 31, 2005, may receive a 90-day CDL with the HazMat endorsement that will allow them to haul hazardous materials while the required assessment is being completed (or verified, if the assessment was completed in the driver’s previous state of residence).
Ninety (90) days prior to the current CDL expiration date, a renewal letter will be mailed to the last known address of drivers currently holding an “H” or “X” endorsement. The letter will explain the HazMat endorsement background check requirements and provide locations of fingerprint collection sites. Missouri has elected to use the vendor contracted by TSA for collection of application data and fingerprints from HazMat endorsement applicants.
The department will notify the applicant by letter after the Final Notice of Threat Assessment has been received. After receiving an approval letter from the department, the driver may apply for a full-term license with an “H” or “X” endorsement.

Every states Insurance code is a little different, most of them are making it harder and harder to discriminate against anything like what you have stated.
Any type of discrimination, espcecially ocurring in the insurance industry is morally wrong, and lawmakers across the country are fighting to make sure it stops..
One of the more recent examples of this was US HR 1076 to prevent discrimination of insurance companies against motorcycleists.

I run an insulation company that involves weather insulation and fireproofing insulation.
A daycare center hired us to use fireproofing insulation in their building. We want to use asbestos because we still have some left over in the warehouse, that we haven’t used yet. And it would be cheaper to use than the new fireproofing.
Why is the Liberal Government infringing on my individual liberties & freedom & capitalistic endeavors to use whichever fireproofing I want? I’m a Job Creator, and the asbestos would make more financial sense for me. Why does Government hate my Freedom?
This is the problem with over-regulation from Government. We can’t create jobs and grow business with such laws that are reminiscent of the Soviet Union under Joseph Stalin.
Shovel Ready: We didn’t “purchase” the asbestos. The asbestos is what we collected when we de-insulated other buildings. We kept it in our warehouse in case we wanted to use the asbestos tiles in other buildings.

Free-markets wouldn’t allow it, you don’t need the government to step in.
No client would want their building with asbestos, thus they would find another contractor to install their insulation, and you would go out of business unless you change, too.
The free market can and will police itself.

Since there is now a hundred billion dollar class action suit saying that Altria came out with light cigarettes to cons smokers into thinking they were safe it is easy to believe them. After they split that judgement they will be even easier to believe.

Hi all!
The cause of this is probably years ago before the government starts banning smoking indoor.
My mum got lung cancer and she’s not a smoker at all.
What happened was the place where she used to work allows people to smoke inside. Therefore, she regularly exposed as a second-hand smoker, which is more dangerous because she didn’t inhale the smoke through a filter.
So I’m just wondering … can we hold the company responsible for this from the law’s perspective?

I answered this question few days ago. here is the copy and paste of my answer:
Such drug is named as “Ipilimumab” known as “MDX-010″ which is intended to activate the immune system.
It is said that such drug sustains an active immune response in its attack on cancer cells. So it indeed sounds to have a promising role in cancer. Whether it is effective or not for cancer is yet to be proven. For the meantime, there are two advanced clinical trials on that matter.Clinical trials are currently on going for its use as the treatment of melanoma.
So, hang on in there until we will hear the results of the trials…..
( PS. I haven’t watched such news but if the drug is under the Mederex company, then I suppose that is the one. The drug is newly released so it is still a “hot” media topic.)

We had a toilet overflow. It was deemed “dirty” water from the bowl. It flooded the bathroom, the hall, a closet and went into 2 bedrooms. The 2 bedrooms had the original floor tile that appears to be asbestos from when the house was built (1956).
The water mitigation company put in their report to the insurance adjuster that the tiles needed to come up b/c moisture did get underneath the tile and the readings were high.
The insurance adjuster then came and he looked everything over and after he left he called the water mitigation company and verbally gave the OK to pull the tile. Their contractor was ill that night and couldn’t come (I had no idea any OK was ever given) and the contractor called me the next day to tell me he was coming out to pull the tile out. I asked him to not come out until I heard back from the adjuster b/c I didn’t want to be stuck with a bill that I couldn’t pay. (this was last Thursday)
So, fast forward to today (Tuesday). I just this morning heard back from the adjuster for the FIRST time since he left my house the day he inspected everything. He left that day telling me it would be “a few” days and he’d get with me to let me know what his thoughts were on damages. He said between the water mitigation co., himself, me and the insurance co – we’d have a “meeting of the minds”. Well, I don’t think that’s happening anymore. Today I’m told by the adjuster that the insurance company has stated that by “NO UNCERTAIN TERMS will the tile in the bedrooms be removed. It is to be cleaned and sanitized.”
I think they are avoiding the cost of the asbestos removal – it was spoken about many times by the water mitigation company and the adjuster about how costly that could run.
After talking to the water mitigation company they described this step of removal of the tiles as the best practice and proper procedure in this situation with sewer water. It’s like going to the doctor when your sick and the doctor orders a test to see what’s wrong but your insurance company won’t approve it b/c they don’t feel the need (that’s the comparison they gave me.)
Your thoughts? If it’s unhealthy – is there documentation somewhere to back that up? That would be nice to see. 
I think my question is more of is it healthy or not healthy? The water mitigation company said yes, there was high moisture levels under the tile. Meaning yes, the sewer water was under the tile. I guess I can’t understand how cleaning and sanitizing the top of the tile will correct that problem. I think I’m in need of some clarification on that part. I don’t feel like the ins. co. needs to pull the tile up if it’s not necessary – my question is…how are we determining that necessity? The water mitigation people say it IS necessary…. I say it really makes sense and I don’t understand how it can be sanitary…
