In a nutshell. I work at an extremely old hotel as a bartender. Recently, I found out that the construction going on upstairs for the last month in the 2nd to 9th floors has been releasing asbestos into the air, and the owner/operator had no plans of warning us about it, hauling carts of broken concrete and flooring right past us that contained it.
I havent contracted any diseases from it, but I was wanting to see if anyone knew for sure, be you lawyer or have gone through this for sure, am I able to file a suit against my employer for exposure or endangerment? Any help would be greatly appreciated.
I know I can prove it with a test, and I quit after I found out. Thanks.

My employer does not have federal minimum wage earnings or family and medical leave rights posted in place of employment. Also does not have MSDS sheets readily available for chemicals in work place. Does not have handicapped accessible parking space. Employer installed neh heat/AC unit and threw what is believed to be asbestos insulation threw holes in duct work leaving it lay on floor with no instructions to clean as far as PPE for employees.

I worked at an asbestos abatement company. In this field there is a medical standard that states the employer must have physicals, chest xrays and respirator fit testing done on the employee. To make a long story short none of this was done even when asked. I quit and was awarded unemployment insurance benefits, now i just received a letter that states my x employer is appealing the decision made by the employment department. I will have to participate in a phone hearing that i think i am prepared for but i wouldn’t put it past my x employer to lie about the facts. What are my chances of winning the appeal?

just as you are betting on them lying.. im sure they are betting on winning simply bc you quit rather than being terminated, hoping they can win on that alone. just document as much as you can and give the as much detailed facts as you can, dates, things you requested but were denied, reason you left, personal safety etc. things they will have a hard time justifying. try not to get angry on the phone, showing you left for valid reasons and not out of anger. usually whoever is calm and more prepared will do well.

There is some evidence that family members of workers heavily exposed to asbestos face an increased risk of developing mesothelioma. This risk is thought to result from exposure to asbestos fibers brought into the home on the shoes, clothing, skin, and hair of workers.
How High is the Risk for Cancer?
Not all workers exposed to asbestos will develop diseases related to their exposure. The risk of developing asbestos-related diseases varies with the type of industry in which the exposure occurred and with the extent of the exposure. Asbestos that is bonded into finished products such as walls and tiles poses no risk to health as long as it is not damaged or disturbed in such a way as to release fibers into the air. When asbestos fibers are set free and inhaled, however, exposed individuals are at risk of developing an asbestos-related disease.
How does smoking affect risk?
Many studies have shown that the combination of smoking and asbestos exposure is particularly hazardous. Smokers who are also exposed to asbestos have a greatly increased risk of lung cancer. However, smoking combined with asbestos exposure does not appear to increase the risk of mesothelioma.
Asbestos diseases are said to follow the trail of exposure. That means that wherever people have received asbestos exposure, regardless of their trade, age, sex or race, they are at risk of cancer and other diseases.
Unfortunately, the effects of asbestos on the human body were known to be deadly for years by the companies who employed the ‘greatest generation’ and made hundreds of millions, if not billions, of dollars off of their backs. But instead of taking simple steps to alleviate the problem and save the lives of thousands of their workers, they choose to do nothing and continue to make a “healthy” profit with a “deadly” product.
A life-threatening illness is terribly emotional. It has a broad impact and affects many people – family, friends and co-workers.
Many employers even went so far as to hide the truth from their workers and their families. And because the normal latency period for Mesothelioma is 20 to 30 years, many got away with this for years.

This is a warehouse that is wall to wall to cieling with asbestos fire proof spray. The workers spend 8 to 10 hours a day in here with little ventilation, just some old fans. Is this legal?

Nope, it’s not legal, and yes, the employer should have notified his employees and he’s breaking federal regulations. Now what are you going to do about it?

I started fussing about it, the boss said keep the asbestos tile floor wet while you strip and wax and you’ll be fine. 2 ys excellent work record, down the tube with write ups on anything until I was termed last month.
Now that I know how dangerous asbestos is, whom can I report them to?
It is for certain that these are asbestos floor tiles.

Get another (independent) doctor. I expect you should easily find a class action on the internet, and the lawyer organizing it may have a doctor he would prefer that you visit.

I was hooking up an industrial strenght air conditioner at work and my supervisor told me to cut some insualtion off an old pipe. Unbeknown to me, the joint of the pipe was insulated to asbestos and a good deal of it became airborne. I probably won’t take legal action, but I am curious.

You can sue anybody for anything – whether you win or not is another issue.
You need to contact OSHA regarding that (and your rights).
