Is this grounds for legal action?
Question by : Is this grounds for legal action?
My fiance worked 9 hours of overtime and his boss won’t pay him for it. He’s supposed to get $ 15 an hour for overtime.
This man owns a construction company and he sends people to work with asbestos and lead paint without telling them and a lot of the workers have babies, including us. He sends his workers to his house to clean his garage and basement and rake his leaves and his son’s as well. I know that he is not allowed to do these things unless he lists himself as a customer and pays for it, and he doesn’t.
There’s a lot of bad things about this company and I’m just wondering if this would be grounds for legal action. I probably wouldn’t pursue it, just threaten so that my fiance gets paid what he deserves

Because labor laws are different depending on where you work it’s difficult to give you the legal “teeth” you are looking for without knowing what country/province/state you are in.
That said, in general the owner of a private company can deploy workers to whatever job site he wants – including his own unless there is a law that says a business owner can’t have his workers work on his personal property for some reason.
Regarding asbestos or other hazardous material handling, I’d be contacting the local office of the EPA (if you are in the US) http://www.epa.gov/aboutepa/index.html and look at their laws/regulations page at http://www.epa.gov/lawsregs.
Regarding overtime, talk to the state agency that oversees labor laws in your state. Every state has their own laws. You can also look at the federal laws that apply to this at www.dol.gov.

Should I get a legal separation and move on without him…please help?
Question by : Should I get a legal separation and move on without him…please help?
SORRY I KNOW ITS LONG
My husband and I have been together for 7 years. We have had our share of problems…Im quite sure everyone does. I know that he loves me and I love him also but He needs to grow up and stop taking me for granted thinking I will always take him back when he does wrong. He say’d he never cheated on me which is good but he loves money and Marijuana and he let that come between us meaning he has to always buy it smoke it sell it and if he don’t he gets all depressed and angry. He gets all emotional and upset at everything. I am a believer of God and I believe in forgiving, When he does little childish stuff like always broadcasting that he has weed or he wants people that looking for some know he got it that pisses me off because I am not into it and believe that you should work to earn a living and not let drug alter and rule your life. I have left him over a dozen times but took him back out of my love and not being selfish but I deserve a better life and I shouldnt have to put up with his weed issues.
He helps out much as he can and is very nice and tells me how much he cares and loves me but soon as he brings up weed it turns me off from him and I just wish he leaves it alone find a job and most of all stop smoking it soo much. I just recently made him leave because this girl texted his phone that lives across from us and we made a agreement that he would not get involved with ppl. we just moved here and before we moved we made that agreement and he broke it. He said he didnt give her his number but im like okay so how the hell did she get it so he start making up excuses that he wanted his friend to hook up with her so they can deal with the marijuana. Even if it was a innocent text, He still broke the agreement. he would call war world 3 if i had a dude texting me. In the past places we lived he would always mingle with the neighbors and crap like that involving weed so I would get fed up with him and make him leave.
Anyways I am tired of giving chances to get walked all over and I am also confused as to if i am doing the right thing being that i married him and I knew better but when we first met he promised that he would stop and he did but broke that promised so i feel like since i married him i am stuck with him because of my religion. Bad part about it is he just got saved the other day so I have been really pissed at him because he claims hes saved but he keep living an illegal life, not trying to change. I swear sometime I be wanting to have him locked up so he can get rehab. He is 28 and I will be 25 this Monday. he always try to make his grandmas believe he is innocent and does no wrong so they wont look at him as a failure but he is not fooling me.
When i do leave him for a while he would come to my place and stalk me…knock on the windows..yell at the top of his lungs saying he loves me and wants me to open door. it even got to the point that he would climb through my window or call my phone none stop. He would not even give me a little break away from him. I don’t know what to do anymore and every year it gets worst because he always say he will change but don’t. He says and do lil things to satisfy me just for the moment. I did alot of things to him out of anger for him hurting and letting me down but he still won’t let me go. He acts as if everything is okay as if we never argued. He is a scorpio too so I know they dont believe or comprehend on someone breaking it off with them. I am cancer and I am very sensitive and loyal but I cant take this no longer, I know it doesnt matter about zodiac signs but Scorpios are very dangerous. Please no mean nasty comments I am here seeking wise advice and I am serious about this so please give me your advice on what to do if you were in my shoes. Thank you all!

Answer by Sheiky Baby
First, it is very bad if he doesn’t stop selling the marijuana. He’s risking going to jail and many worse things.
Second, don’t use horoscopes, they are always wrong.
He needs to grow up. You need to move on if he doesn’t. Or there are problems inside his mind that he has to overcome. You can help him overcome. He is smoking/selling to cover underlying psychological problems. He has to overcome that, with or without you.

Q&A: Where do I go to get answers about end of life legal issues?
Question by Teresa P: Where do I go to get answers about end of life legal issues?
I have a friend who has end stage lung cancer. He would like to make bequests of his personal property (house, car, etc) where can we get information on how to do this without the expense of a private attorney?
Best answer:
Answer by manabell
Unless your friend already works with a financial advisor who knows about estate planning as well, you really do need to consult an attorney who specializes in estate planning.
He needs to make sure his will is current, beneficiary designations on IRA’s, etc. are correct, power of attorney, healthcare power of attorney are ok.
These are important issues that must be addressed. Consider the cost peace of mind.
After all, if his will is not in order, his things will go through probate and he will fork over that money in tax. In actuality, he is saving money by hiring the attorney.

Am I under any obligation (legal or otherwise) to tell my prospective employees about my health problems?
Question by Sir Hoochalot: Am I under any obligation (legal or otherwise) to tell my prospective employees about my health problems?
To cut a very long story short, at the start of this year I was admitted into hospital after coughing up a litre or so of blood over about three days. After numerous tests – broncoscopy/scans/chest X-rays – they found out the the source of the bleed was a leaky blood vessel set deep in the bottom of my right lung. Until it happens again they cannot be sure whether the problem is specific to that vessel or whether I have a problem that is general to all. If it is the former and it happens again, the treatment is the removal of the part of the lung the problem is in and if it is the former, steroids would be the treatment.
Ok that wasn’t as short as I hoped! But anyway, my problem is that there is obviously a chance I cough have another haemorrhage and I am worried that if I tell any prospective employers this, they will not employ me, for fear that I will be off work – if I need chest surgery, I will be off my feet for months. So am I under any obligation (legal or otherwise) to tell them?
I really need a job and am currently searching, but this is a big worry of mine.
Best answer:
Answer by Patrick O’Ryan
If it isn’t something contagious, which could affect the workplace, you have no moral or legal obligation to tell your employer. Such is the case with women, they don’t have to tell their prospective employer that they are trying to have a baby, and would take Family Medical Leave Act time off to give birth, etc. Same principle.
If you let the prospective employer know; you risk not getting hired. I been in hiring positions before. If I had two candidates or more, all with the same qualifications, I’d look for disqualifiers.
They don’t have to tell you that you weren’t hired for medical reasons, they would be open to a lawsuit, but they can find someone with the same quals, and no issues.
Don’t let the employer know.

Q&A: Do You Think Marijuana Should Be Legal in th U.S.?
Question by : Do You Think Marijuana Should Be Legal in th U.S.?
Before you answer, ask yourself these questions:
Are you against any form of marijuana legalization?
Are you in favor of a movement to make alcohol illegal?
If you answered ‘no’ to both questions above, you are, by virtue of association, a hypocrite.
Marijuana has been PROVEN by the British Medical Journal to be less dangerous then alcohol; Both socially and direct damage from the substance.
In fact if you take in all the social costs (health costs, etc) and damage from the substance, alcohol get a rating of 72/100 (100 being most serious).
Marijuana gets a score of 20/100. Marijuana is over 3 and a half times SAFER then alcohol when looking at ALL areas. Anyone who is an alcoholic should switch to marijuana as a safer alternative. The success rate for people addicted to alcohol quitting by using marijuana is 100%! Marijuana on the other hand is less addictive then caffeine! It doesn’t cause lung cancer, it isn’t a gateway drug, it doesn’t kill brain cells…
I am sincerely hoping the United States wakes up one day and smells the hypocrisy. The US can’t make alcohol illegal because the experience with prohibition was a disaster. FYI the addiction rate for other drugs rose 44% during alcohol prohibition, imagine what’s happening as long as marijuana illegal…

Please explain to me why pot is soooooo bad but cigarettes and liquor aren’t. What does pot do thats so much worse than the other two?
Should we get it legalized and ban ciggies instead.
I’m curious to see how people view this drug.

Best answer:
Answer by Jeff P
If you look at the history of criminalizing drugs, mainly Pot, it’s because of Tobacco Corporations realizing that it was a strong competitor and they wanted to get rid of it.
After that, it was n the interest of not looking like fools to keep it illegal.

Q&A: Why I think Weed should be Legal? Religion & Reasons?
Question by : Why I think Weed should be Legal? Religion & Reasons?
Okay so this is just my view into why I think it should be legalized. Weed is something that is natural. I mean after all it is grown from the growned, so in a religious perspective, god made everything that is natural and marijuana or the weed plant is pretty normal. Now I guess Under the Controlled Substances Act of 1970, marijuana is classified as a Schedule I drug on the basis that is has “a high potential for abuse.
Okay I guess I understand that but what about alcohol? Alcohol is far more dangerous an intoxicating then weed or anything else for that matter. Now many people in the US are ADDICTED to alcohol, constantly buying, drinking, dying and getting in trouble with the law for drunk driving and alcohol makes you do violent and reckless things. So that just shows the biggest “legal” addiction in America.
Another thing that catches my attention would have to be the cigarettes. Now from my knowledge cigarettes have over x amount of poisons and toxic chemicals in it. Which causes black Lungs, respiratory complications, breathing problems, many say cancer, the list I’d ENDLESS. but just like alcohol cigarettes are/can be a ADDICTIVE. I know because of some of my family members. Hmm this legalized drug is pretty risky with all the additives of toxins and poisons in it.
So what makes weed so much of a bad thing? I mean everyone is addicted to something. Someone can be addicted to food, become obese and die, someone could be hooked on caffeine and can’t get off weather it’s coffee or soda. So that’s me just showing some examples.
But now look at weed. Natural if not tampered with. An herb from the earth. Why should we be held back from smoking weed? Somethings that is HARMLESS opposed to alcohol and cigarettes?
Anyone ? Please answer and correct me if I’m wrong or forgetting something or you have a different view.

Q&A: your reasons why marijuana should or shouldn’t be legal?
Question by TJ: your reasons why marijuana should or shouldn’t be legal?
Before you put your reason read these marijuana myths and facts most people don’t know
Myth:
Marijuana Can Cause Permanent Mental Illness.
*Fact:
There is no convincing scientific evidence that marijuana causes psychological damage or mental illness in either teenagers or adults. Some marijuana users experience psychological distress following marijuana ingestion, which may include feelings of panic, anxiety, and paranoia. Such experiences can be frightening, but the effects are temporary. With very large doses, marijuana can cause temporary toxic psychosis. This occurs rarely, and almost always when marijuana is eaten rather than smoked. Marijuana does not cause profound changes in people’s behavior.
Myth:
Marijuana is Highly Addictive.
*Fact:
Most people who smoke marijuana smoke it only occasionally. A small minority of Americans – less than 1 percent – smoke marijuana on a daily basis. An even smaller minority develop a dependence on marijuana. Some people who smoke marijuana heavily and frequently stop without difficulty.
Myth:
Marijuana is More Damaging to the Lungs Than Tobacco.
*Fact:
Moderate smoking of marijuana appears to pose minimal danger to the lungs. Like tobacco smoke, marijuana smoke contains a number of irritants and carcinogens. But marijuana users typically smoke much less often than tobacco smokers, and over time, inhale much less smoke. As a result, the risk of serious lung damage should be lower in marijuana smokers. There have been no reports of lung cancer related solely to marijuana.
Myth:
Marijuana Has No Medicinal Value.
*Fact: Marijuana has been shown to be effective in reducing the nausea induced by cancer chemotherapy, stimulating appetite in AIDS patients, and reducing intraocular pressure in people with glaucoma. There is also appreciable evidence that marijuana reduces muscle spasticity in patients with neurological disorders.
Myth:
Marijuana is a Gateway Drug.
*Fact:
Marijuana does not cause people to use hard drugs. What the gateway theory presents as a causal explanation is a statistic association between common and uncommon drugs, an association that changes over time as different drugs increase and decrease in prevalence. Marijuana is the most popular illegal drug in the United States today. Therefore, people who have used less popular drugs such as heroin, cocaine, and LSD, are likely to have also used marijuana. Most marijuana users never use any other illegal drug. Indeed, for the large majority of people, marijuana is a terminus rather than a gateway drug.
Myth:
Marijuana Kills Brain Cells.
*Fact:
None of the medical tests currently used to detect brain damage in humans have found harm from marijuana, even from long term high-dose use. An early study reported brain damage in rhesus monkeys after six months exposure to high concentrations of marijuana smoke. In a recent, more carefully conducted study, researchers found no evidence of brain abnormality in monkeys that were forced to inhale the equivalent of four to five marijuana cigarettes every day for a year. The claim that marijuana kills brain cells is based on a speculative report dating back a quarter of a century that has never been supported by any scientific study.
Myth:
Marijuana Use During Pregnancy Damages the Fetus.
*Fact:
Studies of newborns, infants, and children show no consistent physical, developmental, or cognitive deficits related to prenatal marijuana exposure. Marijuana had no reliable impact on birth size, length of gestation, neurological development, or the occurrence of physical abnormalities.

Why are cigarettes still legal?
Question by natashaiera: Why are cigarettes still legal?
I understand that 50 years ago we did not know how harmful cigarettes were to our bodies, but now that we’re more educated, and know that cigarettes slowly kill you, why is it legal to smoke them? Not only do you kill yourself by smoking them, but you’re making everyone around you suffer for their poor decisions. So many people have died of serious diseases such as lung cancer when they don’t even smoke. Isn’t it illegal to commit suicide? So isn’t it the same thing?

Q&A: Is it legal for the only Oncologist in the county to deny you service after being an ongoing patient for years?
Question by : Is it legal for the only Oncologist in the county to deny you service after being an ongoing patient for years?
My mom has had cancer for almost 10 years…she has beaten 5 different types and is now suffering from lung and liver cancer. Her doctor gave her a 30 day notice this past week saying that he will not treat her anymore after 30 days. Siting inappropriate outburts and refusing consultation as grounds. My mom said she was at the emergency room all of Thursday with severe stomach cramps, this is how she found out she had colon caner about 10 years ago. Well she had a Chemotherapy infusion on Friday and that takes about an hour and the doctor was supposed to come down and talk to her, well after waiting 4 hours she said “i just want to get the f*** out of here” not angrily just out of frustration to the nurse the nurse said “I completely understand you were here most of yesterday as well!” so she tried the doctor again and got no response so my mom left. Well my mom got a call from the doctor’s head nurse about 3 hours later and she told my mom she had to come pick up her records and explained that my mom had 30 more days of treatment there and she needed to find another oncologist. My mom is well below the poverty level for income…the state wouldn’t let her get disability because she beats a cancer then gets a new one but with little to no downtime between the outbreaks. Her sole income is from social security and she had to fight to get that. She can not work since she has chemo and radiation therapy multiple times a week. She also just lost her house where she lived for 20+ years. I’ve tried looking at the Code of conduct and some of the legal guideline but its extremely difficult to find what im looking for, and I am not versed in “legalese” so most of it makes little sense to me. So I turn to you Yahoo answers community to help me out…any help is desperately needed and would be greatly appreciated!
