Do smokers deserve civil rights?
Question by Tanya S: Do smokers deserve civil rights?
Seems like they just keep taking them away. First we have to go outside, be 20 (or however many) feet from the door even in the rain snow ect. Then the fire – safe cigarettes. They puts holes in our clothes, burn us and we have to just take it. Then anytime the government is hurting for money, what’s the first thing they raise taxes on? You guessed it, cigarettes. Here in NYC it’s up to $ 9 a pack! Do any other smokers feel just a little discriminated against?
I’d like to hear from smokers and non smokers alike. I’ll just get this out of the way now too, and let everyone know there is no scientific proof that second hand smoke causes lung cancer. http://www.medicalnewstoday.com/articles/113713.php
So all you anti – smoking people read that first plz, and keep it civil. I don’t come in to your house and dump out your beer (or w/e ur vice is) or make you go stand outside to drink it!
Also, what’s with that rude fake cough people do when I smoke near them on the street? Hell-o! You are OUTSIDE! Ugh!
Damn, some non smokers are so angry! haha, I can’t help but laugh at the ignorance.

Passive smoking may not cause lung cancer, but it can cause things like Bronchitis and it can still be very harmful. I do think that things have gone a bit too far (I had no idea you had to be 20 feet away from the door etc.) but it’s for the non-smoker’s best interests. What I think the government should do is have smoking and non-smoking pubs. We’ve already established that smoking and non-smoking areas don’t work, as the smoke doesn’t know that it’s a non-smoking area and it still travels there anyway. Having a choice would eliminate all the problems.

Are smokers’ rights being taken away from them?
Question by Sean
: Are smokers’ rights being taken away from them?
i read a very short article this morning on cnn.com mentioning how New York City is introducing a bill that would ban smoking outdoors-here’s the link:
http://pagingdrgupta.blogs.cnn.com/2010/09/16/new-york-city-tries-to-ban-outdoor-smoking/?hpt=T2
Before i go any further, i’d like whoever reads this to know that i don’t smoke, and that nearly my entire family has passed from lung cancer due to heavy smoking. i am well aware of all the horrible things smoking does to smokers and second hand smoking.
i fear this is going to be a bit of a rant, and i must apologize in advance. But i’ve been getting more and more angry as i learn about more bans going on with where a smoker can smoke. i live in New Jersey. Smoking has been banned in bars, in restaurants, and a lot of companies are now banning people from smoking on the premises. There were designated areas in restaurants-smoking and non, and in bars, granted, i’ll give them that one. But nevertheless, i feel like the government is just taking away all of a smokers’ rights to smoke. i understand the fact that it’s very oftentimes offensive to second hand smokers, but if they don’t like the smell, they can go somewhere else. And again, second hand smoking is obviously something that can be equally as jeopardizing to one’s health as first hand. But i feel like (i’m a Republican mind you) the government is just further taking away peoples’ rights, that it’s getting larger in what it does, and it’s invading even further into peoples’ private lives.
So yes. Again, let it be known that i am well aware of why these bans are being suggested or have already been implemented, but what are your thoughts on the matter?

Q&A: Should a mother have rights to not allow proper chemotherapy for her son?
Question by : Should a mother have rights to not allow proper chemotherapy for her son?
I heard a story about a mother who insisted on practicing natural health remedies to try and help cure her son with cancer instead of using chemotherapy. The mother ran away with her son in order to use the natural cures that she really thought would cure her son. She was eventually caught and punished. If you had to side with the mother, how would your back up your debate?
Best answer:
Answer by addsnake
I know the case you speak of, and there is no way to side with the mother in that case. She was not arrested for pursuing natural remedies per say, she watched as her child got worse and worse while using the natural remedies and did nothing to stop it. She was not even going to some one who was considered a doctor. Her child went from a mild case of cancer to being terminal because the mother did not do anything. Where as I have nothing against natural remedies at all. It is just common sense to try something else when what you are doing is not working. That is the inexcusable part, no that she went the natural route at first, but that she did not go a different route when that was obviously not working.
There is really no winning argument for the mother’s side. One could argue that she acted in good faith and just lacked common sense. But even that argument is slightly weak. Although its probably the only argument that exists.

I don’t consider children property of parents. I side with the society who protects the rights of the child from the parents.
If the child dies, manslaughter, negligence and murder would all be charges that I would vote for on her jury.

Q&A: My landlord has me living in unsanitary conditions. As a dweller to the home what are my rights!?
Question by La Fontaine: My landlord has me living in unsanitary conditions. As a dweller to the home what are my rights!?
My landlord has me and my family living in a home that has a damaged rug that was damaged due to 2wo floods that occured because of pipe problems. (Remember it’s his home and his pipes that caused our flooring to be damaged) The rug is filled with sewage water. 2wo the basement has mold on it walls which is definetely unsanitary and can cause serious breathing problems (lung infection, asthma, etc.) As a dweller to the home I would like to know if I were to call the city (NYC) 311 and complained about the conditions if the landlord at his will could remove us from his home with out legitament reason. The reason he might want to react like this is because we are paying low rent compared to other residents in the area. I’ve lived here all my life but after my parents died things have fallen apart drastically.

My mom is an alcoholic and a heavy smoker… what can I do? What are my rights?
Question by Om-nom Bacterium: My mom is an alcoholic and a heavy smoker… what can I do? What are my rights?
I’m seventeen years old, and my mom is an alcoholic. She weighs no more than 115 lbs, and drinks a 24 oz beer, plus a six pack, and plus several glasses of wine.. every night. Its so scary. I hate to see it.. its just like Jekyl and Hide. She turns into a complete monster. She also smokes over 2 packs a day; her father died from lung cancer less than 6 months ago, and she still hasn’t quit! the ceiling in the living room slants up toward the loft so all of the smoke funnels into my room. If I open my window, she screams at me to close it. I’ve tried telling my dad, and my grandparents, but they have done nothing. The only advice I’ve been given is to just get out of there. Except the fact that I can’t drive, and don’t have a car. I’ve taken driver’s ed, but my mom won’t let me get my permit. I just want to escape every now and then. I can’t take the drama, and her constantly blaming all of her problems on me. Her constant denial of everything. One time it got so bad, that her boyfriend Jamie told me to find the alcohol, and get rid of it. I said okay, so I did. The next thing you know, she flies around the corner, and literally throws me across the room by my hair. My face hits the wall, and despite the fact that I’m crying and really freaked out, she grabbed my head and threw it against the linoleum floor screaming that she’s an adult and she can do what she wants. I don’t want a stupid ala-non group. I don’t need emotional support anymore… I need to escape when things get violent.

Student civil rights violated?
Question by Brandi
: Student civil rights violated?
Okay… so me and my friends are starting up a revolution here. I believe they are taking our freedom of expression rights away. Facial piercings are not allowed, not even clear ones, and this is kind of a long story but here it goes.I brought some DANGER ASBESTOS HAZARD police tape to school. me and my friends wore some on our left upper arms just for fun, but it came to symbolize something. Our school wants to make us take it down because they say it is distracting to the school environment. To me, it now symbolizes our freedom of expression and style. Thinking of the Tinker case, what s the big difference? We are protesting against the school taking away our civil rights. I wore a headband made from it, and she made me take it off, and she confiscated my roll, did she have a right to?
The basic question is… could you please help me find a list (online) of student civil rights or/and Louisiana public school laws. You are helping to bring down the man-teehee.
with much love-Brandi Sims
Best answer:
Answer by Jessie
The kids in the Tinker case had a black arm band–not distracting at all. People were upset because of WHAT it represented. It sounds like your “ASBESTOS” tape IS causing a distraction to learning (in which case they CAN take your tape) and I seriously doubt that you are really trying to express some sort of view. You are just trying ruffle some feathers, not express an opinion. The school isn’t violating your civil rights, give me a break. In your case I believe the school is correct for confiscating your roll of tape.

California ranks number one in the United States for deaths resulting from malignant mesothelioma. Filing a mesothelioma claim is a complicated matter. You only have a set amount of time in which to begin your case, and it you do not do so within the time limit, you forfeit any chance you would have had at receiving compensation. Therefore, you should start the process as early as you can by contacting a Asbestos Attorney at one of the many law firms in California.
Many mesothelioma court cases have been won in favor of the plaintiff, and often times the verdict awarded him or her over million in damages. For example, in 2000, the plaintiff in the case of Jeannette Franklin vs. USX Corporation was awarded .5 million in damages resulting from asbestos exposure in her childhood home. In the case of David Bakkie v. Union Carbide Corporation, a former plastics molder was awarded .5 million in damages due to his mesothelioma diagnosis. There have been many more pro-plaintiff cases throughout recent history in California, showing that the state takes their role as guardian of public health very seriously. Some of the areas they may help with are lost wages, medical bills, and arrangements in the event of death.

Effects of Asbestos Changed to Compensatory Rights with Mesothelioma Lawyer
Article by Dean McDurmont
Most people who grow mesothelioma have worked on jobs where they inhaled asbestos, or they have been exposed to asbestos dust and fiber in other ways. It has also been optional that washing the clothes of a family member who came in contact with asbestos can put a person at risk for developing mesothelioma. Unlike lung cancer, there is no connection between mesothelioma and smoking, but smoking greatly enhances the risk of other asbestos-induced cancers. Those who have been exposed to asbestos have collected damages for asbestos-related disease, including mesothelioma. Remuneration via asbestos funds or mesothelioma lawyer is an important issue in law practices regarding mesothelioma. Being diagnosed with cancer, particularly a rare and highly lethal one like mesothelioma is more than shocking for any individual and his or her family. From biopsies to treatment, you must be ready to shell out a sizeable amount of money when dealing with asbestos cancer. This does not have to be a problem for you if you know how to find the right person who will help you in this time of need.
Another thing that could help you in cutting back time and money in finding the mesothelioma lawyer to help you with your legal issues is asking other people who have had a same experience. Look for people who were able to win remuneration from their former companies because of mesothelioma cancer. Note the procedures they had to undergo in order to put a plausible case against the violators. This will save you a lot of time, energy and money in planning a strategy to get your compensation. One more thing you could opt for in finding the right services for you is to look online. There are thousands of articles on the Internet written by people who have gone through the same experience as you. Checking out online also makes it much easier for you to converse with them directly, whether through e-mail or other means.

I have a question about my working rights?
Question by cutiehoney242: I have a question about my working rights?
I have worked for a job for 2 years. I finally accumulated enough hours to take a vacation (40 hours) and see my grandmother who is dying. I came back in August to work. Around Mid-September she took a turn for the worst and I took a day off because I thought she was about to die and I wanted to be by the phone for my mother who is taking it hard. Last month a HUGE list of things happened:
My father ended up getting very very ill and ended up in the ICU. He had a heart attack, his blood sugar was through the roof, he got sepsis (a blood infection), AND pneumonia which shut down one of his lungs.
My grandmother ended up in the ICU with her second stroke. Not only this, she has Pulmonary Fibrosis (a lung disease with no cure)
My grandfather has a stroke (different part of the family)
My daughter got EXTREMELY ill. She is 3 and I had to have her in and out of the hospital. Her lungs sound horrible, still, even after a month and the docs are trying to find out what is going on.
My uncle died from Liver Failure.
I ended up having to take 2 days off the week before last, and then the hospital wanted my daughter out of school for a whole week. I found daycare for most of that week, but a few days I had to leave early to get her (one hour one day) and take 1 more day off. This left me with no sick hours. (Since I had used my vacation prior not knowing all of this would come up)
I got an email from my boss stating that if my attendance continues like this I will basically lose my job.
Now I am an excellent worker and things like this don’t happen all the time. I also have doctors notes for all of the time I was out for my daughter.
What can I do? I am afraid if I have to take my daughter in again I will lose my job, even though I have provided notes.
Is this legal? To let somebody go over attendance if it is for the health of their child and they provided doctors notes?
I need to know how to proceed. I am basically in tears right now, and they won’t stop….
Best answer:
Answer by Joe B
Unless you’re invoking the family leave act, it’s perfectly legal.
You have to give notification that you’re taking this type of leave before being absent, otherwise it’s not an excuse.
Understand your priorities are meaningless to most employers. Either give notice of the leave (probably without pay) or don’t plan on missing work for any reason if you value your job.
My guess is that you got on your bosses sheet list once you took your vacation time all at once, usually that’s frowned upon. On top of this you keep missing work, this is how your boss is interpreting the situation.
