I worked at an asbestos abatement company. In this field there is a medical standard that states the employer must have physicals, chest xrays and respirator fit testing done on the employee. To make a long story short none of this was done even when asked. I quit and was awarded unemployment insurance benefits, now i just received a letter that states my x employer is appealing the decision made by the employment department. I will have to participate in a phone hearing that i think i am prepared for but i wouldn’t put it past my x employer to lie about the facts. What are my chances of winning the appeal?

just as you are betting on them lying.. im sure they are betting on winning simply bc you quit rather than being terminated, hoping they can win on that alone. just document as much as you can and give the as much detailed facts as you can, dates, things you requested but were denied, reason you left, personal safety etc. things they will have a hard time justifying. try not to get angry on the phone, showing you left for valid reasons and not out of anger. usually whoever is calm and more prepared will do well.

Deaths from cancers of the kidney, liver and uterus are on the rise, as is mortality from malignant melanoma, especially amongst males. Education, increased funding and the acceptance from males to visit the doctor at the first sign of any health problems (rather than grinning and bearing it until it’s too late) are helping to decrease the mortality rate, especially with diseases such as prostate cancer.However, lung cancer claims more female victims than any other cancer, including breast cancer, and the number of victims is rising. Deaths amongst women from lung cancer were recorded at 30 per 100,000 in 2005, compared to 18 per 100,000 women in 1971. Amongst men there has been a dramatic reduction in the number of deaths caused by lung cancer over the same period. In 1971 it accounted for 107 deaths per 100,000 but in 2005 was just less than half that figure at 53 deaths per 100,000 men in the population. The overall drop in mortality amongst men is thought to be because of the reduction in tobacco consumption, as warnings about the links between smoking and lung cancer were identified towards the end of the twentieth century. The rise in the number of cases amongst women can be attributed to the uptake in smoking by females at the beginning of the 1980s. Since 1986 young women have consistently smoked more than young men, impacting on future mortality rates. Although death rates from cancer are on the decline in general, there is a need for more education as people continue to put themselves at risk by indulging in excessive consumption of cigarettes and alcohol, even though both substances have been proved to increase the risk of contracting certain cancers. As well as extensive documentation available from the NHS and government sources, cancer charity organisations are also working hard to deliver messages about avoidance of cancer risks.

My father-in-law was recently diagnosed with mesothelioma. He is a disabled vet on a limited income. The life expectancy is only 4-18 months. He and my mother-in-law have filed a lawsuit against the asbestos manufacturer. The concern is that they have very little money and without compensation we are afraid that my mother-in-law will lose their house when he passes. Does anyone have experience with this?
Thanks for answering. The lawyer says that because he has the disease that we have a good case. Mesothelioma is caused almost exclusively by asbestos exposure.
We have filed the suit against the manufacturer because we believe that he was exposed while working in the boiler room while in the army and suing the army just isn’t an option.
The lawyer we have retained has been involved with thousands of these cases. He has given us examples of awards won by his law firm, but I want to know what the chances are of not winning.

Lawsuits like that take years to even get to court. The companies have big time lawyers, much more than the average person can afford. I see commercials on tv all the time about a class action lawsuit against the manufacturer, so that hasn’t even come to fruition yet. Like I said, years.
